California Client Rights and Compliance
This page explains rights that apply to California clients. It does not replace the written agreement and cancellation notice each California client must receive before payment.
How Tough Study is classified
For California compliance purposes, Tough Study is an employment counseling service because it offers paid career counseling, career planning, and résumé-development services. Tough Study is not an employment agency. It does not procure or place clients in jobs, act on behalf of employers, or provide job openings as a placement service.
No job or employment guarantee
No verbal or written promise or guarantee of any job or employment is made or implied under the terms of this contract.
Tough Study provides preparation, professional materials, planning, and support. Employers and other third parties control hiring and advancement decisions.
Written agreement before payment
Before Tough Study accepts a fee or a client becomes obligated to pay for an employment counseling service, the client must receive and sign the required written agreement. It will be dated, consecutively numbered, completed in triplicate, and signed by the client and Tough Study. The complete agreement will describe the services, timing, duration, fees, payment dates, applicable refunds, the no-guarantee disclosure, and the client’s cancellation notice. This website page is not that agreement.
Three-business-day cancellation right
A California client may cancel the employment counseling services agreement in writing, without penalty or obligation, within three business days from the agreement date. The client’s written agreement will state the transaction date, exact cancellation deadline, delivery instructions, and required cancellation notice. If Tough Study has not complied with the written-agreement requirements, the cancellation right continues as provided by California law.
Surety bond and filing
California law requires a covered employment counseling service to maintain a current surety bond in the amount of $10,000 and file a copy of that bond with the California Secretary of State. Tough Study will not accept payment for a covered service until the required bond is active and the filing is complete. Paid enrollment is currently closed while this requirement is completed.
